The ruling is final, but Kaminsky enjoys immunity as a representative of the currently opposition Law and Justice Party. The politician, who served as Interior Minister in the PiS government until the end of November, described the court’s decision as “sheer injustice,” which he says is “despicable” and therefore “does not take into account.”
The background of the case is that in 2015, a court in Warsaw found that in 2007, during the first PiS government, Kaminski organized a CBA provocation, which he managed at the time, by resorting to alleged bribery, as a result. In which an official in the Ministry of Agriculture was accused of corruption. For this reason, in 2015, Kaminsky was sentenced to three years in prison and banned from practicing public affairs for ten years. The ruling was not final.
The politician was pardoned by President Andrzej Duda in November 2015, and the court invalidated the case. However, the Polish Supreme Court overturned the annulment in June this year and referred it to court again. The cloaked corpse noted that a presidential pardon is not possible in the event of a non-final ruling.
According to the court’s decision issued on Wednesday, Kaminsky’s actions “violated trust in the state and created a feeling of danger among citizens,” while “in a democratic state (…) the authorities must act in a way that does not violate the constitution.” Citizens’ feeling of security.
In addition to Kaminski, three former high-ranking employees of the CBA were also convicted, who were also pardoned by the head of state in 2015. Malgorzata Babroka, State Secretary in the Office of the President, told PAP news agency on Wednesday that she considered the presidential pardon still valid in light of constitutional requirements.
Simon Holonia, speaker of parliament’s lower house, told reporters that if he receives the appropriate petition from the court, “a decision should be issued” to end Wasik and Kaminski’s term. Holonia added that this issue is unprecedented, so it must be analyzed.
