In the European Parliament elections, Hungary forms a single electoral district, and the levels of appeal and legal remedies are therefore different from those applied in parliamentary elections.
There are four types of election committees in the June 9 election process:
- Voting counting committee (SZB),
- local election commission,
- Regional Election Commission (Capital),
- and the National Election Commission (NVB).
In the case of judicial review, the court has jurisdiction.
The Counting Committee operates on voting day, June 9, and decides on issues that arise during voting: for example, on the rejection of those wishing to vote, the rejection of applications for mobile ballot boxes, and the verification of the authenticity of votes.
The Local Elections Committee decides on objections to the actions and decisions of the vote counting committee, as well as objections related to other acts committed at the polling station, and all objections specifically related to the individual list, individual electoral district, compensation list, settlement nationality or mayoral elections. This body also decides on objections relating to the election of Members of the European Parliament, which relate only to the area of competence of the Local Election Commission.
The Regional Election Commission (Budapest City Election Commission) decides on all objections relating specifically to district or metropolitan municipal elections, municipal elections of regional citizenship or election of the mayor. In addition, it decides on appeals against the decision of the Local Election Commission, which do not fall within the jurisdiction of the Local Election Commission and relate only to the area of competence of the Regional Election Commission. It also adjudicates objections relating to regional, local or on-demand media services or journalistic products not nationally distributed (in these cases, jurisdiction is determined by the domicile or domicile of the media content provider).
The NVB operates throughout the election period
The National Electoral Commission works throughout the electoral process: this body examines whether parties and their lists that wish to run in the European Parliament elections meet the requirements of the electoral law. The NVB also drew lots to rank the European Parliament lists on the ballot, count the votes cast at foreign missions and by post, and determine the outcome of the European Parliament elections.
In addition, the NVB decides on all objections that do not fall within the jurisdiction of the local or regional election commission and the location of the commission cannot be determined, on appeals against the decision of the regional election commission, on national elections written media service and nationally distributed press products, as well as the election of cinemas. Applications for judicial review against the second instance decision of the Regional Electoral Commission and against the decision of the NVB are decided by the court.
