Previously, in March 2024, Nintendo had offered Daly an option on the deal, and while both sides appeared to accept the deal, the site remained active. Even the latest warning issued in May did not work, so Nintendo filed a lawsuit in federal court in Seattle, Washington, demanding the immediate shutdown of the modified devices and damages.
